La gestión gratuita de negocios ajenos

Abstract

Desde su origen en la antigua Roma hasta la actualidad, han convivido dos negocios jurídicos lícitos, el contrato de mandato y el cuasicontrato de la negotiorum gestio, entre los que existen muchas diferencias, pero también importantes semejanzas. Ambos tienen por finalidad esencial la administración y gestión de bienes, patrimonios o negocios de terceras personas de forma gratuita. En esta característica común centramos nuestro estudio, en la gratuidad, para conocer mejor las causas o motivos que la justifican, destacando especialmente su perdurabilidad en el tiempo, a través de diferentes ordenamientos jurídicos, hasta los más modernos cuerpos legales vigentes

Two licit juridical businesses have coexisted since their origin in ancient Rome up until the present: the contract of mandate and the quasi-contract of negotiorum gestio. There are many differences but also many similarities between them. Both have the essential end-purpose of the administration and the management, in a gratuitous manner, of third party goods, patrimony and business. I shall centre the study on this shared characteristic, on the gratuity, especially highlighting their permanence over time, through the different legal orders, up until the most modern legal corpora currently in force.
