Intereses de préstamos de dinero. Limitaciones legales y efectos civiles de su abusividad en el Derecho Romano

Abstract

El trabajo estudia las limitaciones a los intereses en las diferentes épocas establecidas por la ley de las XII Tablas, las leges foeneraticiae, y las constituciones imperiales de época postclásica y justinianea, así como las consecuencias civiles de acordar/pactar intereses ilegítimos. El estudio finaliza con unas reflexiones en las que se destacan la aplicación de las soluciones jurídicas romanas al problema planteado por las cláusulas suelo en el derecho español.

The article studies the limitations to the interests in the different periods established by the law of the XII Tables, the leges foeneraticiae, and the postclassic and justinianeas Imperial Constitutions, as well as the civil consequences of agreeing/negotiating illegitimate interests. The study ends with some reflections in which the application of the Roman legal solutions to the problem raised by the ground clauses in Spanish law are highlighted.
